Terms of Service
Last updated: October 5, 2026
These terms are an agreement between you and Zilanti LLC, a Florida limited liability company ("Zilanti", "we", "us"), for your use of OnsiteBoard: the iPhone and Android apps, the browser dashboard, and the pages OnsiteBoard hosts for your customers (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you use the Service for a company, you agree for that company and confirm you can bind it.
Section 16 contains an arbitration agreement and a class action waiver. It affects how disputes are resolved. You can opt out of it within 30 days, as described there.
1. Who can use OnsiteBoard
- OnsiteBoard is a business tool for independent field service businesses in the United States. It is not for personal, family or household use.
- You must be at least 18 and able to enter a binding contract.
- You are responsible for your account, for keeping your sign-in secure, and for everything done under it. Tell us right away at support@zilanti.com if you think someone else has access.
- The information you give us about yourself and your business must be accurate and kept up to date.
2. Subscription, trial and billing
- Trial. New accounts get a free trial with every feature. The length is shown in the app before it starts. No payment method is needed to start the trial, and it does not turn into a paid subscription by itself.
- Subscription. OnsiteBoard Pro is an auto-renewable subscription bought through the Apple App Store or Google Play. The price, the billing period and what is included are shown on the purchase screen before you pay.
- Automatic renewal. Your subscription renews automatically at the end of each period, at the then-current price, and is charged to your Apple or Google account, until you cancel. On the App Store, auto-renew must be turned off at least 24 hours before the end of the current period to avoid the next charge. Google Play's timing is shown in Google Play.
- How to cancel. Cancel any time in your Apple account subscriptions or Google Play subscriptions, or tap Manage under your plan in the app's Settings, which opens the right page. Cancelling stops future renewals. You keep access until the end of the period you've paid for.
- Refunds. Payments are processed by Apple or Google, and refunds are handled by them under their policies. We cannot issue refunds for store purchases ourselves.
- Price changes. If we raise the price, Apple or Google will notify you before it applies to your subscription, and where the store requires it, you'll be asked to accept the new price. Otherwise the subscription ends.
- Without a subscription, your customers, jobs, estimates and invoices stay viewable. Creating new work needs an active trial or subscription.
- Taxes. Apple or Google collect any sales tax that applies to the subscription.
3. Your business is yours to run lawfully
OnsiteBoard helps you run your business. It does not make you licensed, insured or compliant, and it does not check that you are. You are solely responsible for:
- any license, registration, permit, bond or insurance your trade needs in your state, county and city, and for showing a license number on estimates, invoices or ads wherever the law requires;
- your prices, estimates, invoices, warranties and the work itself;
- deciding whether sales tax or other taxes apply to your work, charging them, and filing and paying them. Tax fields in the app only do the math on the rate you enter;
- consumer protection rules that apply to your sales, for example the FTC Cooling-Off Rule and state home solicitation laws that give homeowners a right to cancel certain sales made at their home, and any required notice of that right;
- the terms, disclaimers and warranty text you put on your estimates and invoices;
- your employees and helpers, and the employment and workers' compensation laws that apply to them.
Anything in OnsiteBoard, on our website or in our guides about licenses, rules, prices or taxes is general information, not legal, tax or insurance advice. Check with the office that sets the rule, or a professional.
4. Your customers, and messages you send them
- Your customer records are yours. You are responsible for having the right to enter your customers' details, and for how you use them.
- Text messages. Texts you start in OnsiteBoard open in your phone's own messaging app and go out from your phone number, as your messages. You may text a customer only as the law allows, including the Telephone Consumer Protection Act and state laws on texting and calling hours. Get the customer's consent before you send reminders or anything promotional, stop when a customer asks you to (mark them "No texts" in the app), text only between 8 a.m. and 8 p.m. in the customer's time zone, and don't text anyone who isn't your customer.
- Email. Estimates, invoices and review requests sent through OnsiteBoard go out on your behalf and show your business name. You're responsible for their content. Review request emails include an unsubscribe link, and we honor it.
- Reviews. You may not use OnsiteBoard to write or buy fake reviews, to offer anything in exchange for a review with a particular rating, or to ask for public reviews only from happy customers. Federal rules (16 CFR Part 465) and Google's policies prohibit these. OnsiteBoard shows every customer the same button to post a public review, whatever their rating.
- Recording. If you record calls, visits or conversations by any means, many states require consent from everyone in the conversation. Getting it is your responsibility.
5. Card payments from your customers
- Card payments are processed by Stripe. To accept them, you open your own Stripe account and agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. We are not a party to that agreement, a bank or a money transmitter, and we never hold your customers' money.
- You are the seller in every sale to your customer. Refunds, disputes, chargebacks and the fees Stripe charges are between you, your customer and Stripe.
- If you add a surcharge or card fee, you are responsible for following card network rules and the state laws that limit or prohibit card surcharges.
- You authorize us to share the data Stripe needs with Stripe, and to receive payment status and amounts from Stripe to show them in the app.
6. Electronic signatures and records
OnsiteBoard lets your customers approve estimates and invoices with a signature on your phone or on a page we host. You are responsible for using electronic signatures where the law allows them, for getting any consent the law requires before relying on electronic records with a consumer, and for keeping your own copies of signed documents. Some documents, like certain permits, liens and home improvement contracts in some states, may need specific wording or a paper signature.
7. AI features
Some features use artificial intelligence (Google Gemini) to read text or photos and suggest customer details, appliance models, job notes, line items or prices. They run only after you allow them in the app, and you can turn them off in Settings at any time. Suggestions can be wrong. Check every suggestion before you save it or send it to a customer. You are responsible for what you send. Starting prices that OnsiteBoard suggests are examples, not recommendations, and you set your own prices.
8. What you may not do
- Break any law, or use the Service to deceive, harass or send unsolicited messages.
- Enter data you have no right to enter, or anyone's card numbers, bank account numbers, Social Security numbers or health information in notes or other free-text fields.
- Access another account's data, probe or overload the Service, get around its limits or security, or scrape it.
- Copy, resell or reverse engineer the Service, except where the law allows it.
- Upload malware or content you don't have the rights to.
9. Your content and our role
- You keep all rights to the data you and your customers put into OnsiteBoard ("Your Content"). You give us permission to store, process and display it only to provide and improve the Service for you, and as described in the Privacy Policy.
- For personal information about your customers, you are the business that decides how it is used, and we act as your service provider (also called a processor). We process it only to provide the Service for you and on your instructions. We don't sell or share it for advertising, don't combine it with other data except as needed to provide the Service, and don't keep, use or disclose it for any other purpose, as required by the California Consumer Privacy Act and similar state laws. We require the same of the companies that help us provide the Service. We'll help you respond to requests from your customers about their data.
- You can export your customers and jobs from the app, and you can delete your account at any time from Settings → Account → Delete account.
9a. Messages from us
We send service messages about your account, such as security alerts, receipts, trial and subscription notices, and alerts about your jobs. These are part of the Service. Tips and offers, by push notification or email, are sent only if you turn them on in the app (Settings → Tips & offers), and you can turn them off there at any time. Marketing emails also include an unsubscribe link. Turning them off doesn't stop service messages.
10. Our property
The Service, including the software, design, text, price lists, trade templates and the OnsiteBoard name and logo, belongs to Zilanti and is protected by law. We give you a limited, personal, non-exclusive, non-transferable right to use the Service for your business while your account is in good standing. On the App Store, the app is also licensed under Apple's standard Licensed Application End User License Agreement. If you send us ideas or feedback, we may use them without owing you anything.
11. Third-party services
The Service relies on third parties, including Apple, Google (Firebase, Maps, Gemini), Stripe and Twilio SendGrid. Their services are governed by their own terms, and we aren't responsible for them. If one of them changes or stops, a feature that depends on it may change or stop.
12. Changes and availability
We may change, add or remove features. We work to keep the Service available but don't promise it will be uninterrupted or error-free. Keep your own records of anything you're legally required to keep, such as tax records.
13. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, ZILANTI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT CALCULATIONS, SUGGESTIONS, PRICE LISTS, GUIDES OR AI OUTPUT ARE ACCURATE OR RIGHT FOR YOUR BUSINESS.
14. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS: (A) ZILANTI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL; AND (B) ZILANTI'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100.
Some states don't allow some of these limits, so they may not all apply to you.
15. Indemnity
You will defend and indemnify Zilanti and its members and contractors against claims, losses and costs, including reasonable attorneys' fees, arising from your business and your work for customers, Your Content, messages you send, or your breach of these terms or of the law.
16. Disputes: arbitration and class action waiver
- Talk to us first. Before filing a claim, email support@zilanti.com with your name, the problem and what you want. We'll try to resolve it informally within 60 days.
- Arbitration. If we can't, any dispute relating to the Service or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator. The Federal Arbitration Act governs this section. The arbitration may be held by video or in the county where your business is located.
- Exceptions. Either of us may bring an individual claim in small claims court, or ask a court to stop infringement or misuse of intellectual property.
- No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding.
- Opting out. You can opt out of this section by emailing support@zilanti.com with the subject "Arbitration opt-out" within 30 days after you first accept these terms.
- If the class action waiver is found unenforceable for a claim, that claim goes to court, not arbitration.
17. Governing law and courts
Florida law governs these terms, apart from its conflict-of-law rules and apart from the Federal Arbitration Act. For any claim not in arbitration, you and Zilanti agree to the state and federal courts in Pinellas County, Florida.
18. Ending your account
You can stop using the Service and delete your account at any time. We may suspend or close an account that breaks these terms or the law, or puts the Service or other people at risk. We'll tell you why when we can. Sections 3–5, 9 and 13–19 survive after an account ends.
19. Changes to these terms
We may update these terms. If a change is material, we'll tell you in the app or by email at least 15 days before it takes effect. If you keep using the Service after that, the new terms apply. The arbitration section won't change for a dispute we already know about.
20. App Store terms
If you got the app from the Apple App Store: these terms are between you and Zilanti, not Apple. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price for the app, if any. Apple has no other warranty obligation. Apple is not responsible for claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims. You confirm you are not in a country subject to a U.S. embargo and are not on a U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
21. Everything else
These terms and the Privacy Policy are the whole agreement between us about the Service. If any part is unenforceable, the rest still applies. Not enforcing a term is not a waiver. You can't transfer these terms without our consent. We may transfer them with the business.
